Terms of use and community rules

Territory is a game: the streets you walk and run become your territory, and other players can take it. These rules keep it fair, safe and fun. By creating an account you accept them.
Who offers Territory
Territory is offered by Jan Conrad Schulte, Wundtstraße 11, 01217 Dresden, Germany ("we"). Email: eda.saxony@gmail.com. See the legal notice.
Territory is free. There are no purchases in the app.
Who can play
- You must be at least 16 years old. We ask for your year of birth when you start.
- One person, one account. Accounts are personal and may not be sold or shared.
- Keep your password safe. You are responsible for what happens with your account.
Play fair
- Record only walks and runs you really did, on foot, with the app recording your real position.
- No fake GPS or location-spoofing apps, emulators, vehicles, or manipulated recordings, and no second accounts to farm rewards or invites.
- Don't try to break, overload or get around the app or its servers.
Stay safe while you play
- Walking and running are physical activities and you do them at your own risk. Check with a doctor first if you are unsure whether you are fit enough.
- Watch the road, not the screen. Follow traffic rules, don't enter private property, closed areas or anywhere dangerous to capture a hexagon, and respect the people around you.
- Distances, times and calorie figures are estimates for the game. They are not medical or training advice.
Community rules
Everything you write or show in Territory is visible to other players: your username and display name, profile picture, posts, captions, photos, clan names and walk (event) details. In all of these:
- No harassment, bullying, threats or hate against anyone, for any reason.
- No sexual, pornographic, violent or shocking content.
- No spam, advertising, scams or links that trick people.
- Don't pretend to be someone else, and don't share other people's personal data.
- Nothing illegal, and nothing that encourages people to hurt themselves or others.
Meeting other players
Group walks bring people who don't know each other together, so creating or joining one needs you to be 18 or older. Meet in public places, tell someone where you are going, and leave if you feel unsafe. Never use a walk to harm, follow or pressure anyone. Report any walk or player that worries you.
Reporting, blocking and moderation
- Use … → Report on a post, walk, clan or player to tell us about something that breaks these rules, and Block to stop seeing a player. The other player is not told.
- We review reports and may remove content, reset names, take away territory or rewards gained by cheating, and suspend or delete accounts that break these rules, without warning in serious cases.
- Some names and words are not allowed and are refused automatically.
Your content and the game
- You keep the rights to what you post. You allow us to store it and show it to other players inside Territory for as long as it is in your account.
- Territory, influence, rankings, skins and rewards are part of the game. They have no money value, can't be traded outside the game, and can change as the game develops (for example when rules are balanced).
Availability, data loss and security
- Territory is a free game offered as it is. We work to keep it running, but we cannot promise that it is always available or free of errors, and features may change or end.
- Your game data can be lost. Activities, territory, rankings, posts, photos and other game data may be lost or reset, for example through a technical fault, an attack on our servers or the end of the game. We do not promise to keep backups for you. If something matters to you, keep your own copy (Profile → Download my data).
- No system is completely secure. We protect your data with reasonable measures (see the privacy policy), but we cannot guarantee that no one will ever break in, and we are not responsible for unlawful attacks by third parties that we could not prevent with those measures. Use a password for Territory that you don't use anywhere else.
Liability
Because Territory is free, we are liable only for damage we cause intentionally or through gross negligence. This limit does not apply, and we are liable under the law without restriction:
- for injury to life, body or health that we cause through our fault;
- under the German Product Liability Act (Produkthaftungsgesetz);
- where we have given a guarantee or fraudulently concealed a defect;
- where data protection law, in particular Art. 82 GDPR, gives you a claim.
Nothing in these terms takes away rights that the law where you live gives you as a consumer and that cannot be waived by agreement.
Ending your account
You can delete your account at any time in the app (Profile → Delete account) or on the account deletion page. See the privacy policy for what we store and how to get a copy of it. We may end the game, or your account if you seriously or repeatedly break these rules, and will tell you in good time where we can.
Law and disputes
- German law applies. If you are a consumer living in another country, the mandatory consumer protection rules of that country still apply to you.
- We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
- If one part of these terms is invalid, the rest still applies.
Changes
If these rules change in a way that matters, the app asks you to accept the new version before you continue playing. The version and date are at the top of this page. If you don't accept a new version, you can delete your account.
